Polymarket challenges Dutch regulator's €420,000 fine in court

Diana Pemberton Political Markets Analyst

Polymarket has filed a legal challenge at The Hague against a €420,000 penalty imposed by the Dutch gambling regulator, Kansspelautoriteit, the company confirmed. The platform contests the fine on the grounds that it attempted to meet the deadline set by the KSA to block access for users in the Netherlands.

The KSA issued the penalty after concluding that Polymarket had offered gambling services to Dutch residents without a licence. Polymarket's legal filing argues the regulator's own timeline was not honoured in the enforcement sequence, a claim the KSA has not publicly addressed.

The challenge places Polymarket among a growing list of prediction market operators in active dispute with national regulators across multiple jurisdictions. In the United States, the platform is party to stayed proceedings in the Sixth Circuit alongside Kalshi and Robinhood. The Dutch action runs on a separate legal track, under European gambling law rather than US commodities regulation, with different resolution criteria and no CFTC preemption argument available to the company.

The Kansspelautoriteit has been one of the more active European regulators in pursuing prediction market platforms, and a ruling against Polymarket at The Hague would establish a Dutch precedent before any harmonised EU framework for event contracts exists.
