FlightAware suit challenges Kalshi's data sourcing for flight markets
FlightAware filed suit against Kalshi on Tuesday, alleging the prediction markets exchange used its proprietary flight data and brand name to power flight cancellation contracts without authorization or licensing agreement. The case, filed in federal court, targets one of Kalshi's higher-volume consumer event markets and raises a question the platform has not yet had to answer at scale: where does licensed data end and public inference begin.
The market implication is structural. If FlightAware prevails on the data-sourcing argument, Kalshi faces either a licensing cost that reprices its operational model or a forced redesign of the underlying market mechanism. Either path creates friction at a moment when Kalshi is expanding its event contract suite aggressively. The deeper risk is precedent — a ruling here would clarify how prediction markets can ingest third-party data, a question with reach well beyond aviation.
