The Commodity Futures Trading Commission filed two simultaneous actions on October 9, drawing a regulatory line between prediction market contracts and traditional gambling products that has direct bearing on the federal preemption fight currently before the courts.
The first action is a proposed rule that would expressly include sports, political, cultural and weather event contracts within the statutory definition of a swap under the Commodity Exchange Act. Chairman Michael Selig described these products as commodity derivatives within the agency's exclusive federal jurisdiction. The proposal is open for public comment for 30 days following Federal Register publication.
The second action is an interim final rule, effective immediately on publication, that codifies the exclusion of sportsbook wagers and casino games from the swap definition. The CFTC's position is that casino-style gambling products are not derivatives and fall outside its remit.
The classification question carries significant legal weight but does not resolve everything. The Sixth Circuit held in September that even if Kalshi's contracts qualified as swaps, the Commodity Exchange Act would not necessarily preempt Ohio and Tennessee gambling laws. That alternative holding remains intact regardless of how the CFTC's rulemaking proceeds.
