DraftKings launched state-specific advertising campaigns in California, Florida, Georgia and Texas within the last 24 hours, targeting markets where sports betting remains either illegal or restricted under state law.
The campaigns, identified by Aldrin Research, market DraftKings Predictions as "now live" in each state and offer new customers $200 in bonuses after a $5 spend. The disclosure in each ad explicitly frames the product under DraftKings' CFTC-registered Futures Commission Merchant status — the same federal registration basis that prediction market operators across the industry have used to argue state gambling law does not apply to their products.
The timing, two weeks before the NFL season opens September 9, is deliberate. DraftKings launched its proprietary exchange DKeX in June and self-certified a parlay contract with the CFTC in August, giving the company control over its brokerage, exchange and market-making layers simultaneously. No other operator currently holds all three in-house.
The advertising push lands as the preemption dispute between federal prediction market operators and state regulators moves through multiple courts. DraftKings is now actively acquiring customers in states where that legal question has not been resolved, using federal registration as the operative permission while the courts decide whether that permission is sufficient.
