Novig wins a second litigation stay as New Mexico joins Massachusetts

A federal judge in Massachusetts put Novig's prediction market lawsuit on hold at the joint request of the operator and state regulators. Novig and New Mexico officials have separately filed for the same pause, leaving the company's litigation frozen in at least two of the five states where it faces active regulatory challenges.

U.S. District Judge F. Dennis Saylor granted the Massachusetts stay. The New Mexico request is pending.

The pattern is the same in both cases: state regulators and the operator have agreed there is no point litigating the underlying jurisdictional question while the broader federal-versus-state fight works its way through the courts. The Ninth Circuit's handling of Nevada's preemption argument, and the CFTC's parallel enforcement posture, will almost certainly determine what any state court can do with a Novig case anyway.
